Shipping FDA-approved Food
About FDA-approved Food
The U.S. FDA’s official website provides statistics for fiscal year 2023 indicating that 30% of all items imported into the U.S. are human food, second only to imported medical devices. The U.S. market has seen significant success in the import of food-related items.
Under the U.S. Federal Food, Drug, and Cosmetic Act, importers of food products intended for introduction into U.S. interstate commerce must ensure that the products are safe, sanitary, and labeled according to U.S. requirements. It’s important to note that all imported food is considered to be interstate commerce.
The FDA does not have the authority to approve, certify, license, or sanction individual food importers, products, labels, or shipments. Importers can bring foods into the U.S. without prior approval as long as the facilities that handle the products are registered with the FDA, and prior notice of incoming shipments is provided.
Imported food products are subject to FDA inspection at U.S. ports of entry. If shipments are found not to comply with U.S. requirements, the FDA may detain them. Both imported and domestically produced foods must meet the same legal requirements in the United States.
